1. Introduction
Bidcout Partners ("we", "us", "our") is a document authentication and apostille advisory practice based in Bangkok, Thailand. This Privacy Policy sets out how we collect, use, store, and protect personal data in connection with enquiries made through our website and through the course of our client engagements. We are committed to handling personal information with discretion and in accordance with the Personal Data Protection Act B.E. 2562 (PDPA) of Thailand.
This Policy applies to personal data collected via our website contact form, by email, by telephone, and in the course of providing our services. By submitting an enquiry or engaging our services, you acknowledge the data practices described here.
2. Data We Collect
2.1 Information you provide directly
When you submit a contact form or enquiry, we collect the information you enter: your name, email address, telephone number (if provided), and the content of your message. In the course of a service engagement, we may receive copies of documents containing personal details such as full legal name, date of birth, nationality, and address.
2.2 Automatically collected data
Our website may collect basic technical data when you visit, including your browser type, device type, IP address, and pages viewed. This is collected via standard server logs and, if analytics cookies are accepted, via an analytics service.
2.3 Cookies
We use cookies as described in our Cookie Policy. Essential cookies are required for the site to function. Analytics and preference cookies are optional and depend on your consent.
3. How We Use Your Data
- To respond to your enquiry and assess the appropriate service for your situation
- To carry out the document authentication or advisory service you engage us for
- To communicate with you about the progress and outcome of your engagement
- To maintain records of completed engagements for our internal quality and compliance purposes
- To understand how our website is used, so we can improve it (analytics, if consented)
We do not use your personal data for marketing purposes. We do not sell personal data to any third party.
4. Legal Basis for Processing
Under the PDPA, we process personal data on the following bases:
- Consent: For analytics cookies and any non-essential processing where we have asked for your consent
- Contract performance: Where processing is necessary to carry out the service you have engaged us for
- Legitimate interests: For maintaining engagement records and responding to enquiries, where our interest in operating a professional practice does not override your rights
- Legal obligation: Where we are required to retain certain records under Thai law
5. Data Sharing
We do not share your personal data with third parties except in the following circumstances:
- Thai government authorities: Documents and associated information are submitted to the relevant Thai authorities (Ministry of Foreign Affairs, district offices, etc.) as part of the authentication service
- Overseas counsel: For Cross-Border Programme engagements, we may share relevant information with overseas counsel named by you or your legal representative as part of the engagement
- Service providers: We may use third-party services for website hosting and analytics. These providers are subject to data processing terms
- Legal requirements: Where we are required to disclose information by Thai law or court order
6. Data Protection
We apply reasonable technical and organisational measures to protect your personal data against unauthorised access, loss, or disclosure. Original client documents are handled only by our processing team, tracked throughout the engagement, and returned or disposed of securely after completion. We retain digital correspondence and engagement records in password-protected systems with limited internal access.
7. Retention
Enquiry data that does not result in an engagement is retained for up to six months and then deleted. Engagement records — including the written advisories and document indices we produce — are retained for five years following completion of the engagement. Documents submitted by clients are returned to clients upon completion; copies are not retained beyond the processing period.
8. Your Rights
Under the PDPA, you have the following rights in respect of your personal data:
- The right to access the personal data we hold about you
- The right to request correction of inaccurate data
- The right to request deletion of your data, subject to our legal retention obligations
- The right to withdraw consent for any processing based on consent
- The right to object to processing based on legitimate interests
- The right to data portability in respect of data you have provided to us
- The right to lodge a complaint with the Personal Data Protection Committee of Thailand
To exercise any of these rights, contact us at [email protected]. We will respond within 30 days.
9. Third-Party Links
Our website may contain links to external sites. We are not responsible for the data practices of those sites and recommend reviewing their privacy policies before providing any personal information.
10. Minors
Our services are intended for adults (persons 18 years and older). We do not knowingly collect personal data from minors. Where a service engagement concerns documentation relating to a minor (e.g. a birth certificate), data is collected from the adult responsible for that engagement.
11. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. The updated policy will be published on this page with a revised Last Updated date. Continued use of our services after a policy update constitutes acceptance of the revised terms.
